Public Procurement
We advise contractors and procuring entities on projects carried out under the Public Procurement Law - from preparing tender strategies and documentation to managing contract execution and resolving disputes. We combine litigation and transactional experience with practical knowledge of the specifics of regulated sectors (including infrastructure, energy, defense, IT, and healthcare). We support procurement and bidding teams to ensure that legal decisions are feasible from a business perspective.
Our Approach
Our interdisciplinary team combines expertise in public procurement with experience in disputes (before the National Appeal Chamber and the courts), contract law and project implementation, compliance and anti-corruption, competition law, regulatory law, and new technologies. This enables us to support clients throughout the entire project lifecycle:
procurement planning → tender process → bid selection → contract execution → changes and claims → audit and oversight → dispute resolution.
How can we help?
- Strategy for participating in the procurement process: analysis of the Terms of Reference (TOR)/Specifications, contract templates, risks, contract terms, evaluation criteria, eligibility requirements, and grounds for exclusion; support in the “go/no-go” decision
- Representation in competitive dialogue, negotiations, or single-source procurement
- Preparation and review of bids, including explanations regarding abnormally low prices
- Preparation of justifications for trade secret claims
- Preparing and negotiating subcontracts and consortium agreements
- Support for contracting authorities: selection of procurement procedure, preparation of tender documentation, evaluation criteria, and draft contracts; responses to contractors’ questions; conducting negotiations (in negotiated procedures)
- Contracts under the Public Procurement Law: analysis and negotiation of clauses (indexation, contractual penalties, security, subcontractors, liability), support in contract amendments
- Project execution and claims: schedules, delays, additional work, disputes over settlements, mediation, and preparation for arbitration or court proceedings
- Appeals and complaints proceedings: representation before the National Appeal Chamber (KIO) and in courts
- Compliance and anti-corruption in procurement: risk assessment, compliance monitoring during the procurement process, and support in conflicts of interest and during audits
- Procurement in regulated sectors (including energy, defense, IT, and healthcare): integrating the Public Procurement Law with industry-specific and regulatory requirements
- Training and workshops for procurement and bidding teams (Public Procurement Law “in practice,” common mistakes, recent case law, contractual clauses)
- Restructuring of entities carrying out public procurement (division, sale of the company).
In our work, we emphasize efficiency, transparency, and proper communication.
We understand that we are entrusted with managing strategic projects and are always available. We strive not only to answer questions but, above all, to address the real business needs of our clients.
